Acceptance of these terms

These Terms of Service (the "Terms") form a binding agreement between you and Huntsville Well Drillers (the "Company," "we," "us," or "our"). By accessing or using huntsvillewelldrillers.com (the "Site") or by submitting any quote request, contact form, or other communication to us, you confirm that:

1. You have read and understood these Terms.
2. You agree to be bound by them.
3. You have the legal capacity to enter into a binding agreement in your jurisdiction.

If you do not agree to these Terms, do not use the Site or submit a quote request.

These Terms incorporate by reference our Privacy Policy, which governs our handling of personal information. Huntsville Well Drillers is the local Madison County network operated by the same team behind Alabama Well Pros; the terms of the local site and the statewide site are substantially similar, with the local site focused on Madison County service and the statewide site focused on connecting Alabama homeowners to a vetted network in their region.

What our service is (and isn't)

What we are. Huntsville Well Drillers is a lead-generation and referral service. We operate a Madison County, Alabama online network that connects homeowners and landowners who need well-related work with independently licensed local well drilling contractors in or near Madison County.

What we are not. Huntsville Well Drillers is not a well drilling company, water well contractor, plumbing contractor, or water treatment company. We do not:

• Perform well drilling, pump installation, well repair, water testing, or water treatment.
• Hold a well driller's license under Alabama Code §22-24-5 or any equivalent license.
• Employ or supervise the contractors in our network — they are independent businesses.
• Issue permits, file ADEM paperwork, or perform regulatory functions on your behalf.
• Guarantee the price, quality, timing, or outcome of any work performed by a contractor we refer.

Eligibility

You may use the Site and submit a quote request only if:

1. You are at least 18 years of age.
2. You are a legal resident of the United States.
3. You have authority to request well-related work for the property you describe (as owner, buyer under contract, authorized agent, or otherwise).
4. Your use of the Site and any contract you enter with a contractor comply with applicable federal, state, and local laws.

If you are submitting a request on behalf of another person or entity, you represent and warrant that you have the authority to do so and to bind that person or entity to these Terms.

Your obligations

When using the Site or submitting a quote request, you agree to:

1. Provide accurate information. Your name, contact details, ZIP code, and project description must be accurate to the best of your knowledge. Inaccurate information may result in misrouted leads, wasted time, or no response at all.
2. Use the service for legitimate well-related inquiries. You agree not to submit requests for any purpose unrelated to a real or reasonably anticipated well drilling, pump, water testing, or water treatment project.
3. Comply with applicable law. You will not use the Site in violation of any law, regulation, or third-party right.
4. Maintain the confidentiality of any account credentials we may issue to you in the future.
5. Honor your commitments with the contractor. If you book a site visit, agree to a bid, or schedule work, honor the commitment. Repeatedly cancelling at the last minute or using the referral service to harvest contractor pricing without intent to engage is prohibited.

Failure to meet these obligations may result in suspension of your access to the Site, refusal of future lead routing, or referral to appropriate authorities.

Accounts, communications & TCPA consent

By submitting a quote request that includes your phone number, you expressly consent, in accordance with the Telephone Consumer Protection Act (47 U.S.C. § 227) and 47 C.F.R. § 64.1200, to receive telephone calls, SMS/text messages, and emails from the matched Madison County well drilling contractor (and, where applicable, from our local routing team) regarding the specific project you submitted. This consent is a condition of using the service so that the contractor can reach you about your project.

You understand and agree that:

1. This consent is limited to your specific project and is not a blanket consent for unrelated marketing.
2. Standard message and data rates may apply to SMS communications.
3. You may opt out at any time by replying STOP to a text, asking to be removed during a call, or emailing us at hello@huntsvillewelldrillers.com.
4. The contractor (and we, where applicable) will respect reasonable contact hours and all applicable Do Not Call and consumer protection rules.

You may withdraw this consent at any time, but doing so may prevent the contractor from following up on your project.

No guarantee of contractor work

We take reasonable steps to vet the contractors in our Madison County network, including verifying:

1. Active Alabama well driller's license (AL Code §22-24-5).
2. General liability insurance.
3. Workers' compensation coverage where required by Alabama law.
4. Reasonable standing with the Better Business Bureau, ADEM enforcement records, and Alabama Attorney General consumer-complaint records.

However, we do not guarantee, warrant, or represent the quality, safety, legality, pricing, timeliness, or outcome of any work performed by a contractor we refer. Specifically:

• We do not guarantee that any contractor is suitable for your specific project.
• We do not guarantee the price quoted by a contractor will match the final invoice.
• We do not guarantee the well will produce the volume or quality of water you expect (this depends on subsurface conditions that cannot be fully predicted).
• We do not act as an insurer, guarantor, or surety for any contractor.

You are responsible for evaluating any contractor, bid, or contract before agreeing to the work. We encourage you to (a) get multiple bids, (b) verify the contractor's license and insurance directly with ADEM and the contractor's insurer, (c) read any contract before signing, and (d) confirm the contractor will file the required ADEM Form 060 (Notification of Intent to Drill a Water Well) and Well Completion Report with the Alabama Department of Environmental Management.

Intellectual property

The Site and all of its content — including text, graphics, logos, icons, images, audio clips, data compilations, software, and the compilation thereof — is the property of Huntsville Well Drillers or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, download, and print content from the Site for your personal, non-commercial use related to evaluating or engaging a well drilling contractor. You may not reproduce, redistribute, sell, modify, or create derivative works of any Site content without our prior written consent.

"Huntsville Well Drillers" and our logo are our trademarks. All other trademarks, service marks, and logos used on the Site are the property of their respective owners.

Prohibited use

You agree not to:

1. Use the Site for any unlawful purpose or in violation of any applicable law.
2. Submit false, misleading, or fraudulent information in any quote request.
3. Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
4. Interfere with or disrupt the Site, its servers, or any networks connected to the Site.
5. Use any robot, spider, scraper, or other automated means to access the Site or extract data without our prior written consent.
6. Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site.
7. Use the Site to harass, abuse, or harm contractors, our staff, or any third party.
8. Harvest or collect contact information of contractors or other users for the purpose of sending unsolicited communications.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this section, including reporting such conduct to law enforcement authorities.

Third-party sites & services

The Site may contain links to third-party websites, including our statewide partner at alabamawellpros.com, as well as government resources such as ADEM and ADPH. These links are provided for your convenience only.

We do not control and are not responsible for the content, privacy practices, or accuracy of any third-party site. The inclusion of a link does not imply endorsement. Your use of any third-party site is at your own risk and subject to that site's own terms and policies.

Disclaimers & warranty

THE SITE AND ALL CONTENT, INFORMATION, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Huntsville Well Drillers DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

1. The Site will be uninterrupted, secure, or error-free.
2. The results obtained from use of the Site will be accurate or reliable.
3. The quality of any information, service, or product obtained through the Site will meet your expectations.
4. Any errors in the Site's software or content will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties; in such jurisdictions, the exclusions above apply to the maximum extent permitted by applicable law.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Huntsville Well Drillers, ITS OFFICERS, DIRECTORS, EMPLOYEERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

1. Your access to or use of (or inability to access or use) the Site.
2. Any conduct or content of any contractor or third party on or through the Site, including defamatory, offensive, or illegal conduct.
3. Any work performed, pricing charged, warranties given, or contracts formed between you and a contractor referred by us.
4. Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SITE OR THESE TERMS EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the limitation of liability for incidental or consequential damages; in such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Huntsville Well Drillers and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

1. Your use of the Site.
2. Your violation of these Terms.
3. Your violation of any third-party right, including any contractor's intellectual property, privacy, or contractual rights.
4. Any claim that your submission of false or misleading information caused harm to a contractor or other third party.

This indemnification obligation will survive termination of these Terms and your use of the Site.

Dispute resolution

We hope you never have a dispute with us. But if you do, here's the process:

1. Informal resolution first. Before filing any claim, email us at hello@huntsvillewelldrillers.com with a description of the dispute and how you'd like it resolved. We'll attempt to resolve it informally within 30 days.
2. Arbitration. If we can't resolve the dispute informally, any unresolved dispute will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted by a single arbitrator in Madison County, Alabama, unless you and we agree otherwise in writing.
3. Class-action waiver. You and we agree that any arbitration or court proceeding will be conducted only in an individual capacity and not as a class action, consolidated action, or representative action.
4. Small-claims exception. Either of us may bring a qualifying claim in small-claims court in the appropriate jurisdiction.
5. Equitable relief. Notwithstanding the above, either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction for matters relating to intellectual property or unauthorized access to the Site.

Governing law & venue

These Terms are governed by and construed in accordance with the laws of the State of Alabama, without giving effect to any conflict-of-laws principles. To the extent any dispute proceeds in court rather than arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in Madison County, Alabama.

You waive any objection to venue or inconvenient forum, including any argument that the chosen forum is inconvenient.

Termination

We may terminate or suspend your access to the Site at any time, with or without cause, with or without notice, including (without limitation) if we believe you have violated these Terms. Upon termination:

1. Your right to use the Site ceases immediately.
2. We may delete any account data associated with you, subject to our legal recordkeeping obligations.
3. Provisions of these Terms that by their nature should survive termination (including but not limited to intellectual property, disclaimers, indemnification, limitation of liability, and dispute resolution) will survive.

You may stop using the Site at any time. To request deletion of your data, see our Privacy Policy.

Changes to these terms

We may update these Terms from time to time. When we do, we will:

1. Update the "Last updated" date at the top of this page.
2. Post the revised Terms on this same URL.
3. For material changes, provide a more prominent notice (e.g., a banner on the homepage) for a reasonable period before the change takes effect.

Your continued use of the Site after the revised Terms take effect constitutes your acceptance of the revised Terms, subject to your rights under applicable law. If you do not agree to the revised Terms, stop using the Site and contact us to close any active lead.
